01-02-2018 Heard learned counsel for the petitioner. None appeared on behalf of the State.

Petitioner, in the present case, is seeking regular bail in connection with Masaurhi P.S. Case No. 231 of 2017 registered for the offence punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a student and not named in the F.I.R. He has got clean antecedent but on recovery of motorcycle in question the same has been shown to be recovered from the market place where this petitioner was seen with this motorcycle.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above

Patna High Court Cr.Misc. No.4627 of 2018 (2) dt.01-02-2018 named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Masaurhi, District - Patna in connection with Masaurhi P.S. Case No. 231 of 2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
