2. The petitioner is in custody since 15.02.2017 in connection with Saraiya P.S. Case No. 52 of 2017 for the offences alleged under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated and in any event only a knife is said to have been recovered from his possession. It is submitted that co-accused Md Azhar from whose possession Glamour motorcycle has been recovered has been granted bail by this Court in Cr. Misc. No. 18278 of 2017 vide order dated 03.07. 2017.
4. Having regard to the nature of accusations and gravity of offence alleged and considering that there are two other prior cases of serious nature in which the petitioner has been remanded, this Court is not inclined to grant the privilege of bail to the petitioner at this stage.
