The petitioner apprehends his arrest in Bihariganj P.S. Case No. 169 of 2014, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 427, 353 and 504 of the Indian Penal Code.

The informant, A.S.I., got information that a lady died in the hospital and thereafter many villagers came and assaulted him and others.

Learned counsel for the petitioner submits that the petitioner is named in the FIR, but no specific allegation is made against the petitioner. Co-accused Binod Kumar has already been enlarged on anticipatory bail and the case of the petitioner stands on the same footing.

Patna High Court Cr.Misc. No.5505 of 2015 (2) dt.10-02-2015 It appears that on account of death of a lady many villagers came and made protest. The informant has not made any specific allegation against the petitioner although the petitioner is named in the FIR.

Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Bihariganj P.S. Case No. 169 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
