JUSTICE SHIVAJI PANDEY ORAL ORDER 22-07-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual Court proceeding. In this case, the petitioners are seeking anticipatory bail in connection with Tekari P.S. Case No. 23 of 2020, registered for the offence under Section 30(a) (c) of the Bihar Prohibition and Excise Act, 2016.

Allegation has been made that about 28 liters of Mahua liquor has been recovered from the house of these petitioners.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

Looking to the quantum of liquor recovered from

No.12364 of 2020(2) dt.22-07-2020 2/2 the house of the petitioners as also the fact that the petitioners have no criminal antecedent, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya, in connection with Tekari P.S. Case No. 23 of 2020, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases, then the concerned Court below would be at liberty to take steps for cancellation of their bail bonds.
