JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-07-2021 Heard learned counsel for the petitioners, informant and learned APP for the State through virtual court proceedings. Learned counsel for the petitioners undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioners seek bail in a case registered for the offence punishable under Sections 341, 324, 307/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case due to village politics. He submits that there is no specific allegation of assault against the petitioners. He further submits

Patna High Court CR. MISC. No.24236 of 2021(2) dt.22-07-2021 2/2 that petitioners bears no criminal antecedent as stated in para-3 of the bail application and they are languishing in judicial custody since 08.09.2020.

However, learned counsel for the informant and State opposes the prayer for bail submitting that petitioner no. 1 Ranjan Manjhi along with co-accused inflicted sickle blow in the abdomen of informant's father on the instigation of petitioner no. 1 Mina Devi.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioners on bail. Accordingly, prayer for bail of the petitioners are rejected in connection with Barauli P.S. Case No. 243 of 2020 pending before the court of the learned Sessions Judge, Gopalganj.
