JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-04-2019 The petitioner seeks bail in anticipation of his arrest in connection with Roshanganj P.S. Case No. 154 of 2018, dated 17.10.2018, instituted for the offences under Sections 379/34 of the Indian Penal Code, Sections 4/21 of the MM(DR) Act, 1957, Sections 4/40 of the BMMV Rule, 1972 and Bihar Minor Eligible Mining Transportation and Storage Rule, 2006/08 and Section 15 of the Involvement Protection Act, 2016.
Though the petitioner has been named in the F.I.R.
Patna High Court CR. MISC. No.19951 of 2019(2) dt.03-04-2019 2/2 along with other accused persons with the allegation of removing the sand from the river bed in an unauthorized manner, but nothing specific has been attributed against the petitioner. The petitioner was not caught on the spot nor any other person has seen the petitioner removing the sand from the river bed.
Considering the facts aforestated and the clean antecedents of the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Sherghati, Distt.-Gaya, in connection with Roshanganj P.S. Case No. 154 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
