16-08-2017 Heard Sri Bakshi S.R.P. Sinha, learned senior counsel assisted by Sri Randhir Kumar No.1, learned counsel for the petitioner and Sri Ram Sevak Choudhary, learned Addl. Public Prosecutor.
This is the 3rd attempt for grant of bail on behalf of petitioner in POCSO Case No. 17 of 2016 (arising out of Ballia P.S. Case No. 303 of 2015) registered for offence under Sections 363, 366(A)/34 of the Indian Penal Code.
At the very outset, it was submitted by learned senior counsel for the petitioner that the case is almost at the fag end and all the chargesheeted witnesses have already been examined, save and except, investigating officer.
Considering the fact that on merit, earlier twice, the
Patna High Court Cr.Misc. No.31878 of 2017 (2) dt.16-08-2017 2/2 prayer for bail of petitioner was rejected, there is no reason to review my earlier order. However, considering the fact that petitioner is in custody since long and only investigating officer is required to be examined, while dismissing the present petition, it is desirable to observe that learned trial court as well as prosecution may take all steps so that the case may come to its logical end without unnecessary delay. It is also necessary to direct the Superintendent of Police, Begusarai to ensure production of the investigating officer as and when required by the trial court.
Let a copy of this order be sent to the Superintendent of Police, Begusarai forthwith.
