JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in anticipation of his arrest in connection with Basantpur P.S. Case No. 335 of 2020 dated 09.08.2020 instituted for the offences under Sections 147, 149, 341, 323, 324, 307, 379, 427, 504 and 506 of the Indian Penal Code.

The petitioner is alleged to have assaulted the Informant by means of an iron rod on his head and along with others is also said to have assaulted the other rescuers. The petitioner but has a different story to narrate. While he was going along with the son and his wife to get his wife treated, some altercation took place at the instance of the local MLA and the petitioner has lodged a case against the

Patna High Court CR. MISC. No.23933 of 2021(2) dt.24-05-2022 2/2 Informant and others vide Basantpur P.S. Case No. 336 of 2020. However from the injury report of the Informant, who is said to have assaulted by the petitioner, it appears that the injury has been caused by hard and blunt substance but no definite opinion could be given initially for want of further medical investigation. However, later, the injury of the Informant has been reported to be simple in nature.

Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 335 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) rishi/- U T
