JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 33(C) of the Indian Forest Act.
The allegation against the petitioner is of removing the soil from the forest area by means of JBC machine for the purpose of construction of irrigation canal.
It is submitted by the learned counsel for the petitioner that the contract for earth work at Manjholi Minar Canal was awarded to M/s Niraj Construction and the petitioner has no concern with the said work.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.5258 of 2015 (2) dt.09-02-2015 2/2 petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Tiwary, learned Judicial Magistrate, Aurangabad (Bihar), in connection with Forest Case No.49/2013/2517/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
