The petitioner has been in custody since 07.10.2017 on his surrender in connection with Ayar P.S. Case No. 64 of 2017 for the offence registered under Sections 365/34 of the Indian Penal Code.
Leaned counsel for the petitioner submits that petitioner is the bosom friend of the deceased and they had gone together for fishing. Thereafter, he did not know the whereabouts of his friend and he had informed the wife of
the deceased that he had left his poultry farm after fishing. The body of the deceased was recovered after a fortnight in a skeleton condition. Learned counsel for the petitioner, thus, submits that save and except the suspicion being cast on the petitioner, there is no further material to implicate the petitioner.
Diary of the present case was called for which has since been received.
Learned counsel for the State, after perusal of the case diary, submits that apart from the allegations as made out in the first information report and the selfconfessional statement made before the police which indicates accidental death, there is no further material to implicate the petitioner.
Considering the entire gamut of circumstances and the material available in the case diary and further that such evidence made before the police by the accused (selfconfessional statement) has no evidentiary value and the petitioner has no criminal antecedent, , let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., VII, Bhojpur,
