Petitioner seeks bail in a case registered for the offences punishable under Section 420,409,467,468,471,506/34 of the Indian Penal Code.
Submission is that a bare perusal of the allegation makes out a case of disciplinary proceeding and not of criminal liability because enhanced money was not paid to the petitioner though work was said to be completed within time. There is no material to substantiate that the petitioner is going to tamper with the evidence or hamper the trial.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like
Patna High Court CR. MISC. No.12104 of 2020(2) dt.29-02-2020 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Barauli Police Station Case No.307 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
