====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner, complainant and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections147, 148, 149, 341, 323, 307, 353, 427, 332, 504, 506 of the Indian Penal Code.

The prosecution case as per F.I.R is that on

No.24167 of 2021(2) dt.18-01-2022 2/3 receiving information that villagers have blocked NH-28 in protest of death of one Jitendra Giri, the informant went with other police personnel at the spot and tried to persuade them. It is alleged that some anti-elements attacked on the police personnel with lathi, danda, bricks, stone and iron rod, as a result of which, several police personnel sustained injuries. They also created hindrance in discharge of official duties of the police personnel.

It is submitted by learned counsel for the petitioner that there is general and omnibus allegation against the petitioner. The petitioner has no concern with the deceased or his family members. He was not apprehended from the spot. The petitioner is an autorickshaw driver and due to village politics, he has been implicated in this case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the aforestated facts, let the

No.24167 of 2021(2) dt.18-01-2022 3/3 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Samastipur in connection Tajpur P.S. Case No. 403 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
