JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Neemchak Bathani Police Station Case No. 132 of 2014 registered for the offences punishable under Sections 341, 323, 307, 507 of the Indian Penal Code and section 25(1-B)/26 and 27 of the Arms Act.

According to prosecution case itself, the alleged occurrence took place on 03.11.2014 and the informant found the Katta which was used in the alleged occurrence on 07.11.2014 and thereafter, he produced the said katta before the police and lodged the present case.

Taking into consideration that no one has sustained any injury and the fire arm was produced by a private person, let the

No.4699 of 2015 (2) dt.04-02-2015 2/2 petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Neemchak Bathani P.S.Case No. 132 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
