JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 399/402/120B of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. A loaded country-made pistol was recovered from the possession of the petitioner. Suspicion is that the petitioner and others were preparing to commit dacoity. The petitioner has got criminal antecedent including cases under Section 392 of the Indian Penal Code.

Submission is that the petitioner is in custody since 12.09.2017. Investigation of the case is complete and the

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of the charge or after completion of one year of custody whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Madhuban P.S. Case No.237 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
