JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 5, 7, 8, 9, 10 and 13 of the Bihar Saw Mill Act and under Sections 41 and 42 of the Indian Forest Act.

The allegation against the petitioner is of running of the saw mill unauthorizedly.

It is submitted by the learned counsel for the petitioner that the petitioner is not the owner of the saw mill and only dust of wood and raw wood were seized, but no wooden log was seized. It is further submitted that there is no independent witness to the seizure list.

No.5259 of 2015 (2) dt.09-02-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikpura, in connection with Case No.37 C2/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
