JUSTICE RAJIV ROY ORAL ORDER 03-05-2024 Learned counsel for the petitioner, at the outset submits that he may be permitted to withdraw paragraph 4 of the petition in which it has been wrongly incorporated that neither the petitioners nor the advocate committed error.
2. This, in the backdrop of the fact that the modification petition has been filed only because in the main petition, the error was there.
3. Earlier the Cr. Misc. No. 85429 of 2023 was preferred and the same was allowed on 29.01.2024.
4. The present modification petition has been filed and it has been stated that due to incorrect statement made in the
Patna High Court CR. MISC. No.25191 of 2024(2) dt.03-05-2024 2/3 main petition, instead of district Supaul, it was typed as Araria. Actually, the matter relates to a case within the jurisdiction of district of Supaul.
5. Learned counsel for the petitioners is cautioned to take care in incorporating the facts.
6. In view of the fact that there is typographical error in the main petition, rejection would make the petitioners suffer who have been extended the privilege of anticipatory bail. The order dated 29.01.2024 stands modified to the following extent:
"7. Let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Supaul, in connection with Chhatapur P.S. Case No. 26 of 2022 subject to the conditions as laid down under Section 438(2) of the Cr.P.C."
7. This is subject to payment of Rs. 2,000/- to District Legal Services Authority, Supaul which will be used exclusively for the purchase of generals.
8. In view of the fact that the order stands modified,
Patna High Court CR. MISC. No.25191 of 2024(2) dt.03-05-2024 3/3 the period of surrender is extended by further four weeks.
9. The Cr. Misc. No. 25191 of 2024 stands disposed of.
