This application, for grant of anticipatory bail, arises out of Pachrukhi P.S. Case No. 126 of 2015, disclosing offences under Sections 147, 148, 149, 341, 323, 302, 201 and 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that it could be seen from the First Information Report that the deceased appeared to have died in a road accident. He has also submitted that the grandson of the informant was also riding in the same motorcycle which was driven by the deceased. Informant's grandson named two persons, namely, Sanjit Kumar Yadav and Upendra Singh, who are said to have assaulted the deceased. The said Sanjit Kumar Yadav and

Patna High Court Cr.Misc. No.13031 of 2016 (6) dt.18-07-2016 2/2 Upendra Singh have been granted bail by this Court vide orders dated 07.12.2015 and 18.12.2015 passed in Criminal Miscellaneous No. 52272 of 2015 and Criminal Miscellaneous No. 57175 of 2015 respectively. The petitioner has no criminal antecedent as stated in paragraph 3 of the application. Considering the above submission, this application is allowed. Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Siwan, in connection with Pachrukhi P.S. Case No. 126 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
