JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 25(1-B)a 26 and 35 of the Arms Act and sections 3,4 and 5 of Explosive Substances Act.

It is alleged that some persons were arrested with arms who disclosed the name of the petitioners and others as persons who fled away from the place of occurrence.

It is submitted by the learned counsel for the petitioners that except confession of co accused there is nothing on record against the petitioners. More over, there is no recovery from the petitioners and petitioners are accused in one other case apart from

Patna High Court Cr.Misc. No.4624 of 2015 (2) dt.03-03-2015 2/2 the present one. It is further submitted that co accused Saheb Rai has been granted anticipatory bail vide Cr. Misc. No. 53559 of 2013.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana at Motihari in connection with Ghorasahan (Lakhaura) P.S. Case No. 151 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioners before the learned court below that they will regularly cooperate with the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in investigation by the petitioners will give liberty to prosecution to file application for cancellation of bail by learned court below.
