Petitioner, already in custody, seeks bail in connection with Bakhri P.S. Case No. 214 of 2017, registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. The allegation in brief is that 7.5 liters of illicit foreign liquor was recovered from near the house of the Sudhir Sada and Jai Jai Ram, respectively and not from the house of the petitioner. Learned counsel for the petitioner submits that similarly situated co-accused has been granted bail by a Coordinate Bench of this Court vide order dated 09.11.2017 passed in Cr. Misc. No. 52699 of 2017 and the petitioner is in custody since more than one and half months.

No.3261 of 2018 (2) dt.30-01-2018 2/2 Having considered the said facts and circumstances, the petitioner, Neeraj Mahto @ Neeraj Kumar , is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 7th cum Special Judge, Bihar Prohibition and Excise Act, 2016 in connection with Bakhri P.S.Case No. 214 of 2017.
