JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 47 of the Bihar Prohibition and Excise Act, 2016.
As per allegation, 8 liters of country made liquor have been recovered from the bush. Nothing has been found from the conscious possession of the petitioner. It is further contended that petitioner is in custody since 04.06.2017.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with
Patna High Court Cr.Misc. No.31963 of 2017 (2) dt.13-07-2017 2 / 2 two sureties of the like amount each to the satisfaction of 12th Additional Chief Judicial Magistrate, Siwan in connection with Nautan P.S. Case No.132 of 2016.
Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
