Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 302, 120 (B), 34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case, in short, is that when the informant's son along with his maternal uncle reached near Saidpur hostel by scooty, he stopped by accused persons namely, Munna Singh, Raushan Sharma, John @ Satyam Kumar (petitioner), Kallu, Vishal Kumar, and Shanu. It is further alleged that Kallu, Vishal Kumar and Jhon @ Satyam Kumar caught the deceased and Raushan Sharma fired on the back of

Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the main allegation is against another co-accused namely, Raushan Sharma and Munna Kumar. Further, it is submitted that the petitioner is in custody since 08.11.2021, charge-sheet has been submitted in this case and has antecedent of two cases.

Learned A.P.P for the State opposes the prayer for regular bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfation of the learned J.M. 1st Class, Patna City in connection with Bahadurpur P.S. Case No. 333 of 2021.
