This is an application for bail in connection with Bettiah (Muffasil) P.S.Case No. 517 of 2016 registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

Petitioner is the husband and the allegation is of dowry death and post mortem report shows that deceased died of strangulation.

It has been submitted on behalf of the petitioner that independent witnesses have not supported the prosecution case and further submission is that there is general and omnibus allegation and he has falsely been implicated in this case and he is

Patna High Court Cr.Misc. No.30677 of 2017 (3) dt.25-07-2017 2/2 in custody for about six months.

Heard learned APP also.

Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude it as soon as possible. With the above observation, this application is dismissed.
