Petitioner, already in custody, seeks bail in connection with Supaul (Laukaha O.P.) P.S. Case No.678 of 2017, registered under Sections 307, 379, 341, 323, 324, 326, 504 and 34 of the Indian Penal Code.

Allegation in brief is that due to land dispute both sides picked up quarrel and allegation against the petitioner is that he gave a sickle blow as a result ear of the informant was cut off. Learned counsel for the petitioner submits that both sides are agnates, there is land dispute between both sides, the ear was bite by the petitioner and not a sickle blow was given, there is case and counter case between both sides and the petitioner has

Patna High Court Cr.Misc. No.9547 of 2018(2) dt.17-02-2018 2/2 no criminal antecedent except one case in between the same parties.

Learned counsel appearing on behalf of the informant submits that there is specific allegation against the petitioner that he cut off the ear by blow of a sickle.

Having considered the said facts and circumstances, petitioner Birendra Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Supaul (Laukaha O.P.) P.S. Case No.678 of 2017, with condition that the petitioner will not tamper with the evidence or make any inducement or threat to the witnesses otherwise his bail bond shall liable to be cancelled.
