JUSTICE SANJAY PRIYA ORAL ORDER 28-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kumarkhand P.S. Case No. 37 of 2017 instituted for the offence under Sections-395 and 397 of the Indian Penal Code.
The petitioner is Nandoshi of the deceased. He lives separate from the family. The husband of the deceased is already in jail.
It is alleged in the written report that sisters of the informant, namely, Munni Kumari and Bulbul Kumari were married to Rajesh Kumar Yadav. It is further alleged that in the night of 18/19-02-2017, the accused persons named in the FIR along with 5-7 unknown persons committed murder of Bulbul Kumari and wrapped and concealed the dead body in soil. When the informant came to the house of her sisters for getting information, he found all the family members of the in-laws of his sisters absconding. He got information that Munni Kumari was taken away anywhere for treatment.
In this manner, there is general and omnibus allegation against the petitioner.
In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kumarkhand P.S. Case No. 37 of 2017 to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhepura subject to condition that both the bailors should be close relative of the petitioner.
