Petitioner is an accused in connection with Sahebganj P.S. Case No. 268 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) (d) (g) and 41 (i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case. It is further submitted that there is no recovery from the conscious possession of the petitioner. The petitioner is in custody since 11.01.2020.

Having considered the above facts and circumstances of the case and that the petitioner has no criminal antecedent, let
