Having regard to the nature of allegation for offence under Section 135 of the Indian Electricity Act and the fact that in the report of the ATC Tower Company, it becomes clear that the petitioner was not a mere guard rather electricity connection for the theft of electricity was being arranged from his house to the Tower Company, this Court would not be inclined to grant privilege of anticipatory bail to the petitioner specially when the petitioner even is not prepared to pay the amount of loss sustained by the Electricity Company. That being so, prayer for anticipatory bail of the petitioner is hereby rejected.

The petitioner must surrender whereafter his prayer for regular bail shall be considered in accordance with law. (Mihir Kumar Jha, J) Sujit/- U
