The present petition has been filed with a prayer to restore I.A. No. 5779 of 2007 filed in C.W.J.C. No. 5801 of 1993, which stood dismissed due to non-compliance of peremptory order dated 01-01-2008.

After hearing learned counsel for the petitioners and considering the ground set-forth in the petition, same is allowed. Let interlocutory application i.e. I.A. No. 5779 of 2007 filed in C.W.J.C. No. 5801 of 1993 be restored to its original file, with a direction to comply order dated 21-01-2008 within a period of six weeks, failing which, the I.A.
