JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

It is alleged that the sister of the informant was killed after three years of marriage though the petitioners are outsider, but it is alleged that they came along with husband of the victim to take the victim to her matrimonial home when the demand of dowry was made by the petitioners.

It is submitted by the learned counsel for the petitioners that the petitioners have not been sent up for trial and final form has been submitted. However, the learned Magistrate took

Patna High Court Cr.Misc. No.5248 of 2015 (2) dt.09-02-2015 2/2 cognizance against the petitioners on 18.7.2012. Considering the facts that the petitioners are not the family members of the victim and they were not sent up for trial, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial no.850/2013, arising out of Paroo P.S. Case No.66/2006, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Since the case was registered in the year 2006, the learned court below will be at liberty to cancel the bail bonds of the petitioners if they default on two consecutive occasions. (Dinesh Kumar Singh, J) PNM U T
