JUSTICE SUDHIR SINGH ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 366A/34 of the Indian Penal Code. Prosecution case is that F.I.R. named accused persons abducted daughter of the informant and petitioner has been made accused by the victim in her statement under Section 164 Cr. P. C. It is submitted on behalf of the petitioner that he has got no criminal antecedent. There is no allegation of abduction against the petitioner. The allegation of abduction is against Dilkhus Kumar. The only allegation is that petitioner forcibly got the victim married to Dilkhus Kumar.

On behalf of the State and the informant, it is submitted that petitioner is not named in the F.I.R. Petitioner has been named by the victim in her statement recorded under Section 164 Cr. P.C. The anticipatory bail of other co-accused, namely, Sikendra Chouhan has already been rejected by a coordinate Bench of this Court vide Cr. Misc. no. 5749 of 2016. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is

Patna High Court Cr.Misc. No.11117 of 2016 (2) dt.27-04-2016 2/2 rejected.

Any how, if petitioner surrenders in the court below, i.e., learned A.D.J.-III, Madhepura, in connection with Singheshwar P. S. Case no. 71 of 2015 within a period of six weeks from the date of receipt of a copy of this order and prays for regular bail, same shall be considered and disposed of on its own merit without being prejudiced by this order.
