The petitioner, in the present case, is seeking regular bail in connection with Dawath P.S. Case No.88 of 2017, registered for offences alleged under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was not identified by the informant. However, the informant claims that he came to know the name of this petitioner and other co-accused from the nearby people and relatives. Nothing incriminating has been recovered from the possession of this petitioner and no other person has come forward to identify him till date. Learned counsel submits that there are two cases
Patna High Court Cr.Misc. No.4752 of 2018 (2) dt.01-02-2018 against this petitioner as stated in paragraph 3 of the application, but he is not aware as to whether the petitioner has been granted bail or not in those cases.
Learned counsel for the State is present.
So far as the present case is concerned, considering the facts and circumstances, let the petitioner, above named, be enlarged on bail, if he is not wanted in any other case, on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bikramganj, Rohtas in connection with Dawath P.S. Case No.88 of 2017, subject to the conditions U/S 437(3) Cr.P.C. and subject to the further condition that the petitioner shall cooperate in course of trial by putting appearance before the learned court below. Two consecutives defaults in putting appearance before the learned court below without any plausible reason shall lead to cancellation of his bail. (Rajeev Ranjan Prasad, J) Arvind/- U T
