The petitioner is seeking regular bail in connection with Sessions Trial Case No. 393 of 2015 arising out of Choutarawa P.S. Case No. 105 of 2015, registered for the offence punishable under Sections 147, 148, 149, 302 and 504 of the Indian Penal Code.
Earlier, the petitioner has moved before this Court for regular bail in Criminal Miscellaneous No. 48329 of 2015 and the Court has rejected the application of the petitioner vide order dated 04.11.2015.
Perused the status report, from where it appears that the Doctor and I.O. have not yet been examined.
Patna High Court Cr.Misc. No.10259 of 2018(3) dt.11-04-2018 2/2 This court directs the Superintendent of Police, Bagaha and Civil Surgeon, Bettiah to ensure the examination of the two witnesses within a period of three weeks from the receipt / production of a copy of this order. The court below is directed to dispose of the case within a period of five months thereafter and report this Court again with respect to the status of the case. If the Superintendent of Police, Bagaha and the Civil Surgeon, Bettiah will fail to produce the witnesses, it will be treated to be disobedience of the order of this Court and this Court may initiate a contempt proceeding against them.
With this observation, this petition is dismissed. Let a copy of this order be communicated to the Superintendent of Police, Bagaha and Civil Surgeon, Bettiah. (Shivaji Pandey, J) ajay gupta/- U T
