====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 01-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Dariyapur P.S. Case No. 15 of 2023 registered for the offence under Sections 420, 120(B) of the I.P.C. and Sections 30(a) and 41(i) (ii) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in brief, is that total 446.760 liters wine is said to have been recovered from three different cars.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.01.2023. He has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of

Patna High Court CR. MISC. No.15278 of 2023(2) dt.01-05-2023 2/2 tampering with the witnesses alleged against the petitioner. There is no chance of trial being concluded in near future. It is alleged that total 446.760 liters wine is recovered from three different cars. The cars in question do not belong to the petitioner. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Ist Exclusive Special Judge, Excise, Saran at Chapra, in connection with Dariyapur P.S.
