The petitioner, already in custody, seeks bail in connection with Jandaha P.S.Case No. 53 of 2016 registered under Sections 304B/34 of the Indian penal Code.

Allegation in brief is that this petitioner, on account of non-fulfillment of demand of dowry, killed his wife by setting fire on her body.

Submission is that it was an accidental burn injury and she was admitted in PMCH by the petitioner and in this case petitioner is facing trial in which the informant and his wife and one another witnesses have been examined and they have not supported the case of the prosecution, however, they accepted that it was a case of accidental burn injury.

No.33342 of 2017 (2) dt.20-07-2017 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Pankaj Kumar @ Pankaj Rai is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Vaishali at Hajipur in connection with Sessions Trial No. 438 of 2016 arising out Jandaha P.S.Case No. 53 of 2016.
