JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 2.8.2017, seeks bail in Rajeev Nagar PS Case No. 198 of 2017 (Special Case No. 108 of 2017) registered under Sections 20/22 of the NDPS Act. The allegation in brief is that 265 grams of ganja kept in different purias was recovered from the possession of the petitioner. Learned Counsel for the petitioner submits that the petitioner has no antecedent of similar nature and the quantity is small. Whereas learned Counsel for the State submits that that he has three criminal antecedents of theft.

Having considered the said facts and circumstances, the petitioner, namely, Mithun Kumar @ Mithun Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge X, Patna in connection with Rajeev Nagar PS Case No. 198 of 2017 (Special Case No. 108 of 2017), with the condition that he shall not indulge in any criminal activity and if any case is lodged against him his bail bonds shall be liable to be cancelled in accordance with law.
