Petitioners seek regular bail in connection with G.B. Nagar P.S. Case No.112 of 2017 registered for the alleged offences under Sections 399 and 402 of the Indian Penal Code and Section 25 (1-B) A/26/35 of the Arms Act.
As per the prosecution case, seven accused persons are said to have congregated for committing dacoity. Out of them four were apprehended by the police on tip off and two mobile phone, motorcycle and cash of Rs.520 was recovered from the possession of petitioner no.1-Manish Mishra and one motorcycle, one knife, mobile and cash of Rs.250 was recovered from the possession of petitioner no.2-Manoj Pandey.
It has been submitted by learned counsel for the
Patna High Court Cr.Misc. No.32516 of 2017 (02) dt.13-07-2017 2/2 petitioners that nothing incriminating article has been recovered from the conscious physical possession of the petitioners. They have been falsely implicated in this case because they failed to cough up the illegal demand of the police. They have no criminal antecedent. They have been languishing in jail custody since 21.04.2017.
In the facts and circumstances of the case, the petitioners above named are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned C.J.M., Siwan in connection with G.B. Nagar P.S. Case No.112 of 2017.
