JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Konch P.S. Case No. 289 of 2019, registered under Sections 341 and 354 of the Indian Penal Code and Section 8 and 12 of the POCSO Act.

The accusation is that on 18.09.2019, when the informant, aged about 15 years, was returning to her house from school and when she reached near Baikatpur Ahari all of sudden, Manoj Chaudhary (Petitioner) caught hold her and tried to outrage her modesty, but, she raised alarm then nearby people came there then petitioner fled away. Before ten years, this petitioner had also outraged modesty of woman of her village.

Patna High Court CR. MISC. No.12112 of 2020(3) dt.15-06-2020 2/2 Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Further submission is that petitioner has been remanded in this case on 27.09.2019 from Aanti P.S. Case No. 41 of 2014 in which petitioner was remanded on 19.09.2019. Sri Rabindra Kumar, learned counsel appearing on behalf of petitioner submits that although, petitioner is accused in Aanti P.S. Case No. 41 of 2014, but he is on bail in that case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Gaya in connection with POCSO Case No. 105 of 2019, arising out of Konch P.S. Case No. 289 of 2019.
