2. The petitioner is apprehending arrest in connection with Belhar P.S. Case No. 269/2024 registered on 25.08.2024 for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 74, 303(2), 352, 351(2), 3(5) of B.N. S., 2023.
3. As per the prosecution, an F.I.R. has been lodged against eight accused persons, including the petitioner. It is alleged that the petitioner, along with the other co-accused, assaulted the informant and his family members. It is specifically alleged that the petitioner assaulted the informant on his finger and shoulder with an iron rod.
4. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has committed no offense. The petitioner and the informant are well known to
Patna High Court CR. MISC. No.13282 of 2025(2) dt.28-03-2025 2/2 each other, as they are residents of the same village and are distant relatives (gotia). It is further submitted that there is a case and counter-case between the parties. For the same date and place of occurrence, the petitioner's side has lodged Belhar P.S. Case No. 268 of 2024 on 25.08.2024. The learned counsel further submits that while the petitioner is alleged to have assaulted the informant on his finger and shoulder, no injury has been found on the informant's person. The petitioner has a clean antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) as mentioned in Section 2(1) (d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 to the satisfaction of the C.J.M., Banka, in connection with Belhar P.S. Case No. 269/2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
