Petitioner, already in custody, seeks bail in connection with Khajekalan P.S. Case No.98 of 2017, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that some persons were brutally assaulting a youth, police reached there but the miscreants escaped away on motorcycle. The names of the persons involved in the offence was disclosed by the local people. Learned counsel for the petitioner submits that it is not disclosed that who has named this petitioner and on mere suspicion the petitioner was made accused in this case, he has clean antecedent, similarly situated co-accused Md. Patna High Court Cr.Misc. No.4289 of 2018(2) dt.01-02-2018 2/2 been admitted to bail by a cooordinate Bench of this Court and police has submitted charge-sheet in this case. Having considered the said facts and circumstances, petitioner Tanvir Alam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City, Patna in connection with Khajekalan P.S. Case No.98 of 2017.
