This application is for grant of regular bail in connection with Darounda P.S.Case No.95 of 2016, for the offences under Section 392 of the Indian Penal Code.

The petitioner is not named in the F.I.R.. It appears that on the basis of confessional statement of the co-accused, the petitioner has been made accused in this case. Submission of the learned counsel for the petitioner is that except confessional there is nothing against him and so far criminal antecedent of the petitioner is concerned, he is on bail in both the cases.

Heard learned A.P.P. also, who has opposed the prayer for bail, stating that he is accused in other cases of similar nature.

No.31725 of 2017 (2) dt.14-07-2017 2/2 Having heard both sides and in view of confessional statement of the co-accused as well as criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. At the same time, the S.P., Siwan is directed to ensure presence of the witnesses on each date so that the trial may be concluded within a period as specified above.

With the aforesaid observation, this application is dismissed.
