JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-01-2022 Heard Mr. Mahendra Pratap, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 03 of 2021 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Though a small quantity of liquor is said to have been recovered from the cattle house of the petitioner but considering the fact that the petitioner was earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to him.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the court below and seeks bail, his application shall be
