In this case, the petitioner is seeking regular bail in connection with Begusarai Town P.S. Case No. 650 of 2022, registered for the offences punishable under Sections 386, 387/34 of the I.P.C. and Sections 25(1-b)a, 26, 35 of Arms Act. As per allegation, when the informant was raising boundary wall on his land, co-accused Bhola Mahto @ Jharkalka demanded rupees five lakhs as ransom and due to non-payment of ransom, seven named accused persons stopped the son of the informant and took his golden chain, a ring and Rs 5000/-. The petitioner was arrested when he was running away after throwing a loaded country made pistol and two cartridges. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.14099 of 2023(2) dt.25-04-2023 2/2 that he is a person of clean antecedent and he is under custody since 23.10.2022. He has falsely been implicated in this case. On the other hand, the learned APP has opposed the prayer for bail.

Considering the clean antecedents as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 650 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
