JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 This is an application for grant of anticipatory bail in connection with Kanhauli P.S. Case No. 162 of 2018, disclosing offences under Sections 147, 148, 149, 323, 324, 307, 353, 427, 447, 448, 452, 379, 380, 120(B), 504, 506, 193 of the Indian Penal Code and Section 3/4 of the Damage to Public Property Act.
Allegation as per F.I.R. is that police on information apprehended some accused persons and villagers assembled there and assaulted the police party in order to keep the accused persons free and the petitioner is also named in the F.I.R. Submission of learned counsel for the petitioner is that nothing specific has been attributed against the petitioner and he is aged about 70 years and having no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 5th Sitamarhi, in connection with Kanhauli P.S. Case No. 162 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
