The petitioner is languishing in custody for the offences punishable under Sections 30(a)/35/38 of the Bihar Prohibition and Excise Act, 2016.

Petitioner is owner of auto rickshaw from which 1728 liters of liquor was recovered. The petitioner has got identical nature of criminal antecedent. He is in custody since 02.01.2019.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on completion of six months of custody if the trial is not concluded in the meantime on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with

Patna High Court CR. MISC. No.18471 of 2019(3) dt.10-04-2019 2/2 two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Uchakagaon P.S. Case No.341 of 2018, with condition that petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
