2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 310 (2) 311 of the BNS.
3. The case of the prosecution is that on 17.07.2024 at about 7:00 hours, he proceeded to Jamui Dulhin Bazar, Patna after 'iron rod' 10 MT loaded in the Tractor of his brother from Magadh Industries, Sabalpur, Patna on the way at about 9:30 hours near Dardha Bridge, white coloured Bolero vehicle overtook him and 10-12 persons got down from the aforesaid vehicle and on the point of pistol committed 'marpit', tied leg and hands as well as closed eyes and mouth of his driver and took him into the bolero vehicle and some persons took the

It is further alleged that they kidnapped his driver on gun point for about three hours at Makhdumpur and in the morning, villagers saved his driver and while returning with his driver, informant found that engine of his tractor was parked at the road side of Dhanarua market. Hence, the present FIR.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that name of the petitioner has surfaced on the basis of the confessional statement made by Deepak Kumar, who was been granted bail by a bench of this Court in Cr. Misc. No. 73353 of 2024 and its analogous cases vide order dated20.01.2025. It is further submitted that 'iron rod' was recovered beside the shop of the petitioner. Further submission is that he has purchased the 'iron rod'. Moreover, the petitioner is languishing in judicial custody since 23.01.2025 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on
Patna High Court CR. MISC. No.12641 of 2025(2) dt.19-03-2025 3/3 bail in connection with Dhanrura P.S. Case No. 400 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-1st, Masaurhi/concerned Court.
