Petitioner, already in custody, seeks bail in connection with Bithan P.S. Case No.95 of 2017, registered under Sections 341, 323 and 376/34 of the Indian Penal Code as well as under Section 4 of the POCSO Act.

Learned counsel for the petitioner submits that the allegation of rape is specific against Md. Afsar and not against this petitioner and only allegation against this petitioner is of abusing and assaulting the daughter of the informant but there is no injury.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.4327 of 2018(2) dt.01-02-2018 2/2 petitioner Md. Arman @ Md. Araman is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Bithan P.S. Case No.95 of 2017 (G.R. No.599 of 2017).
