The petitioner seeks bail in Excise Case No. 79 of 2018 registered under Sections 30(a)(d) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

35 litres of country made liquor and 520 litres of jaggery are said to have been recovered from the hut of the petitioner and the petitioner was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. She has no concern either with the seized liquor or with the aforesaid hut. As

No.21190 of 2018 (2) dt.16-04-2018 2/2 a matter of fact, the petitioner had gone to her relative in the P.O. village and has been falsely implicated in the case merely on suspicion. She has no criminal antecedent. She happens to be lady and has been languishing in custody since 08.03. 2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge cum Special Judge, Excise Act, Samastipur in connection with Excise Case No. 79 of 2018.
