JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 414/120B/34 of the Indian Penal Code.

The petitioner is suspected to be in possession of stolen truck as he was apprehended from nearby the truck. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 31.01.2017 and he has got no criminal antecedent. In fact, the petitioner and the real driver were traveling on the said truck in the State of Jharkhand near Ranka when some criminal snatched the said vehicle and for that the driver had lodged police case. The said

Patna High Court Cr.Misc. No.18429 of 2017 (4) dt.04-07-2017 2/2 truck was in abandoned condition left by those criminals and the police, during patrolling, found the petitioner near the truck and apprehended him.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of Sri Kavindra Kumar, learned Judicial Magistrate, 1st Class, Dehri, Rohtas/Successor Court, in connection with Rohtas P.S. Case No.26 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
