JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 25-04-2018 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner being the husband of the victim has renewed the prayer for anticipatory bail in a case registered for the offences punishable under Sections 302, 201 and 120B of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 20 years of marriage and disposing of the dead body.

It is submitted by learned counsel for the petitioner that the victim developed illicit relationship with one Munna Ram for which she was scolded by her husband, the petitioner when she committed suicide.

Patna High Court Cr.Misc. No.23552 of 2018 (2) dt.25-04-2018 However, the petitioner earlier preferred Cr. Misc. No. 37710 of 2015 with a prayer for anticipatory bail when this Court vide order dated 17.09.2015 directed the learned Court below to consider the prayer for regular bail of the petitioner provided he surrenders within a period of six weeks. However, it is submitted that since the petitioner had gone to Punjab to earn livelihood hence, he could not surrender in time. No fresh ground has been made for renewing the prayer for anticipatory bail, this Court is not inclined to revise the earlier order. However, keeping in view the statement made in paragraph 10 of the petition, which reads as follows:- "That the petitioner is migratory labour and he had gone to Punjab for earning his livelihood and his two minor sons are dependent on him and as such could not comply the earlier direction of this Hon'ble Court to surrender within six weeks in the court below from the date of order."

this Court extends the period of surrender of three weeks from the date of receipt/production of a copy of this order in connection with Paharpur P.S. Case No. 167 of 2015 pending in the Court of learned Chief Judicial Magistrate, East
