2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 120B,406/34 of the Indian Penal Code.
3. According to F.I.R., it is alleged that the petitioner, who is uncle of the informant, fraudulently sold the ancestral land, which was in share and possession of the informant.
4. Learned counsel for the petitioner submits that the land in question was jointly purchased in the name of the petitioner and informant's father. On 26.06.1979, the petitioner and informant's father purchased the other disputed land and according to the share of this petitioner, he sold his land to

It is next submitted that in this case dispute is with regard to sale and purchase of land between the parties which is essentially civil in nature and informant has got alternative remedy before the civil court. Petitioner claims clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwantnagar P. S. Case No. 496 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
