JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The two petitioners apprehend arrest in relation to Buxar Town P.S. Case No.82 of 2014 instituted under Sections 147, 148, 149, 341, 302 and 307 of the Indian Penal Code. Learned counsel for the petitioners submits that the order of the learned Sessions Judge would itself show that there are specific allegations of firing, catching hold, etc. against various persons named in the F.I.R., but there is no specific overt act as against the petitioners, even though they are named in the first information report. Three persons were killed. Learned A.P.P. submits that the injury report would show a number of injuries. There is no dispute in this regard. He could not show any overt act as against the two petitioners. Be that as it may, in the facts and circumstances of

No.17682 of 2015 (2) dt.08-06-2015 the case, in the event of their arrest or surrender in the court below within four weeks from today, the petitioners above named shall be released on bail on each of them furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar Town P.S.Case No.82 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
